1. Acceptance of Terms

By accessing or using Notestream, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use the platform. These terms apply to all visitors, registered users, producers, and buyers. We reserve the right to update these terms at any time, and continued use of the platform after changes are posted constitutes acceptance of the revised terms.

2. User Accounts

To access certain features of Notestream, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate and complete registration information and keep it up to date. You may not create multiple accounts for deceptive purposes, share your account with others, or use another person's account without permission. Notestream reserves the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

3. Content Ownership

Producers retain full ownership of the beats, instrumentals, loops, and sound kits they upload to Notestream. By uploading content, you grant Notestream a non-exclusive, worldwide license to host, display, stream, and distribute your content solely for the purpose of operating the platform and facilitating sales. You represent and warrant that you own or have the necessary rights to all content you upload and that your content does not infringe on the intellectual property rights of any third party.

4. Licensing and Sales

When a buyer purchases a beat or other content on Notestream, they receive a license as defined by the seller's chosen license terms. Notestream acts as a marketplace facilitator and is not a party to the license agreement between producer and buyer. Producers are responsible for setting accurate license terms, pricing, and usage restrictions. Buyers are responsible for adhering to the terms of the license they purchase. Notestream collects a platform service fee on each transaction, the details of which are disclosed before purchase completion.

5. Prohibited Conduct

You agree not to use Notestream to upload, distribute, or sell content that you do not own or have rights to. You may not use the platform to engage in fraud, harassment, spamming, or any activity that disrupts the experience of other users. Automated scraping, data mining, or unauthorized access to the platform's systems is strictly prohibited. You may not circumvent any security measures, manipulate play counts or sales metrics, or attempt to reverse-engineer the platform's software. Violations may result in immediate account termination and legal action.

6. Termination

Notestream may suspend or terminate your account at any time for violations of these terms, fraudulent activity, or any conduct deemed harmful to the platform or its users. You may also delete your account at any time through your account settings. Upon termination, your right to use the platform ceases immediately. Any pending payouts will be processed according to our standard payout schedule, provided no violations are under investigation. Content you have uploaded may be retained for a reasonable period to fulfill existing license obligations.

7. Limitation of Liability

Notestream is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, Notestream shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the platform. This includes, but is not limited to, loss of revenue, data, or business opportunities. Our total liability for any claim related to the platform shall not exceed the amount you paid to Notestream in the twelve months preceding the claim.

8. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via email or through a prominent notice on the platform at least thirty days before they take effect. Your continued use of Notestream after the effective date of any changes constitutes acceptance of the updated terms. If you do not agree with the revised terms, you should discontinue use of the platform and close your account.
