Intellectual Property Rights
Notestream respects the intellectual property rights of all creators and expects its users to do the same. Producers who upload content to the platform retain ownership of their original works. Buyers receive usage rights as defined by the specific license they purchase, not ownership of the underlying composition or recording. Unauthorized reproduction, distribution, or resale of content obtained through Notestream is a violation of copyright law and these terms. Notestream's own branding, design, and proprietary software are protected by copyright and trademark law.
DMCA Takedown Process
If you believe that your copyrighted work has been uploaded to Notestream without authorization, you may submit a takedown notice under the Digital Millennium Copyright Act. Your notice must include:
- Identification of the copyrighted work you believe has been infringed.
- Identification of the material on Notestream that you claim is infringing, including a direct URL.
- Your contact information, including name, address, phone number, and email.
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
- Your physical or electronic signature.
Submit takedown notices to copyright@notestream.io. We aim to review and respond to valid notices within five business days.
Counter-Notification
If your content was removed due to a DMCA takedown notice and you believe the removal was made in error, you may submit a counter-notification. Your counter-notification must include your contact information, the specific content that was removed, a statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification, and your consent to the jurisdiction of a federal court in your district. Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within ten business days, the removed content may be restored.
Repeat Infringers
Notestream maintains a policy of terminating the accounts of users who are determined to be repeat copyright infringers. If a user receives three valid DMCA takedown notices, their account will be permanently terminated and they will be prohibited from creating new accounts. We track all copyright complaints and their resolutions. In cases of egregious or willful infringement, we may terminate an account after a single verified complaint at our discretion.
Fair Use
Notestream acknowledges that certain uses of copyrighted material may qualify as fair use under applicable law. However, the determination of fair use is a complex legal analysis that depends on the specific facts of each case. Notestream does not make fair use determinations on behalf of its users. If you believe your use of copyrighted material constitutes fair use, you may raise this as a defense through the counter-notification process. We recommend consulting a qualified attorney if you have questions about whether your use of specific material qualifies as fair use.
